These Terms of Service ("Terms") are an agreement between you and Armiger Gameworks, Inc. ("Armiger", "we", "us"). They cover the Armiger website, the Armiger app and our related services (the "Service").
You accept these Terms when you create an account, or when you accept them in the app. If you do not accept them, do not use the Service.
If you live in the United States, section 17 requires you to resolve disputes with us through individual arbitration and waives class actions. You can opt out of it within 30 days.
Our Privacy Policy tells you how we use your personal data.
1. Who can use Armiger
- You must be 16 or older.
- If you use Armiger for a group or an organization, you confirm that you can accept these Terms for it.
- You may not use Armiger if U.S. law does not let you receive services from a U.S. company, for example because you are on a U.S. sanctions list.
2. Your account
- Give us accurate information. Keep your email address current: we send account and security email there.
- Keep your password safe. You are responsible for what happens on your account. If you think that someone else has access to it, tell us at [email protected].
- An account is for one person. Do not share, sell or transfer it.
- If you sign in with Discord, Google or Apple, the terms of that service also apply to that sign-in.
3. Armiger is in beta
Features change, and some come and go. The Service can be slow or unavailable and can have bugs, and data can be lost. Keep your own copy of anything that is important to you.
4. What Armiger does
Armiger is a set of tools for tabletop role-playing games: campaigns, characters and character sheets, a rules engine, a virtual tabletop with maps and tokens, GM screens, documents, file uploads, campaign chat, direct messages, dice rolls, session scheduling with calendar feeds, and games that you play with your group. The app keeps a copy of your data on your device so that it works offline, and it syncs your changes when you reconnect.
5. Your content
"Your content" is what you put into Armiger: campaigns, characters, documents, maps, images and other files, homebrew rules, chat and direct messages, dice rolls, schedules and feedback.
- You own your content. These Terms do not give us ownership of it.
- You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display and adapt your content. We use this license only to run, secure and improve the Service, and to show your content to the people that you share it with. The license ends when your content is deleted from the Service, except for copies that other people already received from you (such as messages that you sent) and for backups that expire on a schedule.
- You confirm that you have the rights to what you upload or share, and that it does not break these Terms or the law.
- We do not sell your content, use it for advertising, or use it to train AI models.
6. Campaigns, chat and direct messages
- What you add to a campaign is visible to its members. The campaign's game master (GM) can invite and remove players and can manage the campaign and its content.
- Campaign chat messages and dice rolls are visible to the members of the campaign. A private message or roll to the GM is visible to you and the GM. You can edit and delete your own messages, and the GM can delete any message or roll in the campaign.
- Direct messages are visible to the people in the conversation. You can edit and delete your own direct messages.
- When a message is deleted, it is removed for everyone. Someone may already have read it or copied it.
- Messages are encrypted between your device and our servers, but they are not end-to-end encrypted. We do not read them, except to deliver them, to look into a report or suspected abuse, or when the law requires it.
- Images and files that you upload are stored at web addresses that are hard to guess. Anyone who has the address can open the file.
- A calendar feed link shows a campaign's sessions to anyone who has it, and an invite link lets anyone who has it join the campaign. Share these links only with people you trust.
7. Acceptable use
Do not use Armiger to:
- break the law, or help someone else break it;
- share sexual content that involves minors, or content that sexualizes minors. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC), as U.S. law requires;
- harass, threaten, bully or stalk anyone, or promote violence or hatred against people because of who they are;
- share another person's private information without their permission;
- infringe copyrights, trademarks or other rights, for example by uploading published game books or art that you do not have the right to share;
- send spam, or pretend to be another person or an organization;
- upload malware, or try to break, overload or probe the Service, or to get around its security or its plan limits;
- get into accounts or data that are not yours;
- scrape, copy or resell the Service, except as the law allows.
8. Reports and moderation
- To report content that you think is illegal or breaks these Terms, use the report option in the app, or email [email protected]. Tell us where the content is and why you think so.
- We can remove content, limit features, or suspend or close accounts that break these Terms or the law. When the law requires it and we can, we tell you what we did and why. You can reply to ask us to review the decision.
- Our single point of contact under the EU Digital Services Act, for users and for authorities, is [email protected]. We communicate in English.
9. Copyright complaints
If you think that content on Armiger infringes your copyright, send a notice to [email protected] with:
- your physical or electronic signature;
- the work that you say is infringed;
- where the material is on Armiger (a link or a description that lets us find it);
- your name, address, phone number and email address;
- a statement that you believe in good faith that the owner, its agent or the law does not allow the use; and
- a statement, under penalty of perjury, that the notice is accurate and that you are the owner or may act for the owner.
If we remove your content because of a notice and you think that it was a mistake, you can send a counter-notice to the same address, as 17 U.S.C. § 512(g) describes. We close the accounts of repeat infringers when it is appropriate.
10. Game content and trademarks
Armiger includes rules content for game systems such as Dungeons & Dragons fifth edition, Pathfinder Second Edition, Call of Cthulhu and Daggerheart. Content that we use under an open license stays under that license. Game names and trademarks belong to their owners. Armiger is not affiliated with or endorsed by Wizards of the Coast, Paizo, Chaosium or Darrington Press.
11. Our Service
- The Service, including its software, design, rules engine and our own content, belongs to Armiger and its licensors. We give you a personal, non-exclusive, non-transferable and revocable license to use it under these Terms.
- If you send us feedback or ideas, we can use them without any obligation to you.
12. Plans, payments and cancellation
- Armiger has a free plan and a paid Pro plan. The app and the checkout show the limits and prices of each plan.
- Polar (polar.sh) sells Pro subscriptions as our merchant of record. Polar takes the payment, charges sales tax or VAT, and issues receipts and refunds. Polar's terms also apply to your purchase. We never see your full card number.
- Pro renews automatically every month at the price that you agreed to, until you cancel. You can cancel at any time in Settings. After you cancel, Pro continues until the end of the period that you paid for, and you are not charged again.
- When you delete your account, your Pro subscription also stops renewing.
- Except where the law requires a refund, payments are not refundable, and we do not refund part of a period.
- If you are a consumer in the EU, the UK or Switzerland, you can withdraw from a new subscription within 14 days of buying it and get a full refund. Email [email protected] or contact Polar.
- We can change the price of Pro. We tell you at least 30 days before the change. The new price applies from your first renewal after that, and you can cancel before it does.
13. Ending your account
- You can delete your account at any time in Settings. Our Privacy Policy tells you what happens to your data.
- We can suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop the Service. We tell you first when we can do so without harm or breaking the law.
- If we stop the Service, we tell you at least 30 days before, and we refund the unused part of a paid period.
- The sections that by their nature must continue after your account ends (including 5, 14, 15, 16, 17 and 18) continue.
14. Disclaimers
To the extent that the law allows, the Service is provided "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service is always available, free of errors or secure, or that its rules calculations are correct for your game. Nothing in these Terms limits consumer rights that the law does not let us limit.
15. Limits on liability
To the extent that the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and
- our total liability for all claims about the Service is limited to the greater of what you paid us in the 12 months before the claim and US $50.
These limits do not apply to liability that the law does not let us limit, such as liability for fraud, or for death or personal injury caused by our negligence.
If you are a consumer in the EU, the UK or Switzerland, we are fully liable for damage that we cause by intent or gross negligence. For slight negligence, we are liable only when we break an obligation that is essential to these Terms, and only for the damage that was typical and foreseeable when you accepted them.
16. Indemnity
You will defend us and hold us harmless against claims by other people that come from your content or from your breach of these Terms, and pay the costs that those claims cause us. This section does not apply to consumers in the EU, the UK or Switzerland.
17. Disputes and arbitration (United States)
This section applies if you live in the United States. It does not apply to consumers in the EU, the UK or Switzerland, or where the law does not allow it.
- Talk to us first. Before either of us starts an arbitration, send a notice to the other with your name, the email address of your account, a description of the dispute and what you want. You send yours to [email protected], and we send ours to the email address of your account. We both try in good faith to settle the dispute within 60 days.
- Binding individual arbitration. If we cannot settle it, you and Armiger agree that the American Arbitration Association (AAA) resolves any dispute that comes from or relates to these Terms or the Service through binding arbitration, under its Consumer Arbitration Rules (adr.org). An arbitrator decides, not a judge or a jury. The Federal Arbitration Act governs this section.
- Fees and location. The AAA rules set the fees. We pay the fees that those rules give to a business. The hearing takes place by video or phone, or in the county where you live.
- Exceptions. Either of us can take an individual claim to small claims court if it qualifies. Either of us can ask a court to stop the infringement or misuse of intellectual property.
- No class actions. You and Armiger bring claims only as individuals, not as a plaintiff or a member of a class, collective, consolidated or representative proceeding. If a court finds this waiver unenforceable for a claim, that claim goes to court and not to arbitration.
- Many similar claims. If 25 or more similar demands for arbitration are filed against us with the help of the same law firm or organization, the AAA's Mass Arbitration Supplementary Rules apply to them.
- Opt out. You can opt out of this section within 30 days after you first accept these Terms. Email [email protected] with the subject "Arbitration opt-out", your name and the email address of your account. Opting out does not change the rest of these Terms.
- Courts. A dispute that is not arbitrated goes to the state or federal courts in Delaware, and to the extent that the law allows, you and Armiger waive a jury trial.
18. Governing law
The laws of the State of Delaware govern these Terms, without regard to conflict-of-law rules. The Federal Arbitration Act governs section 17. If you are a consumer in the EU, the UK or Switzerland, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there.
19. Changes to these Terms
We can change these Terms. Before a change that matters takes effect, we tell you by email or in the app, at least 30 days before when the change is against your interests, unless the law or a security problem requires a faster change. We then ask you to accept the new Terms when you next sign in. If you do not accept them, you can stop using Armiger and delete your account. A dispute is governed by the Terms that applied when it started.
20. General
- These Terms and the Privacy Policy are the full agreement between you and us about the Service.
- If a part of these Terms is unenforceable, the rest stays in effect.
- If we do not enforce a part of these Terms at once, we can still enforce it later.
- You cannot transfer these Terms without our permission. We can transfer them as part of a merger, an acquisition or a sale of assets, and we tell you when we do.
- We are not responsible for delays or failures caused by events outside our reasonable control.
- We send notices to the email address of your account. You send notices to [email protected].
